Terms and Conditions:

This User Agreement is a contract between you and Safe Case Corporation (“we”, “our” or “us” as appropriate). This agreement describes your and our rights and responsibilities when you purchase products from our website. (“Services”).

As Safe Case’s business is constantly evolving and we are adding additional features an products from time to time, it is necessary for us to amend the Agreement and Policies to reflect the changes. We may amend this agreement at any time by posting the amended terms on our website. All amended terms shall be effective immediately after being posted on our website.

Legal and Enforceable Online Contract.

By processing your pending order through the utilization of your credit card, you agree that you have entered into a legal and enforceable online contract with Safe Case Corporation cc, and accept the Terms and Conditions as stated in this “Conditions of Use and Sale” to govern your pending transaction with Safe Case Corporation.

  1. Eligibility. Our services are only available to individuals or businesses who/that can enter into legally binding contracts under applicable law. Without limiting the foregoing, our Services are not available to minors (under 18), persons who are suspended from our Services, or to persons who present an unacceptable level of credit risk. In order to purchase any of Safe Case’s products online, you must register for a Setcom account and verify the e-mail address before the transaction will be completed. By purchasing items from this website, you affirm that you are 18 years of age or older.

 

  1. Product Display/Colours. Safe Case’s website attempts to display product images shown on the website as accurately as possible. However, we cannot guarantee that the colour you see matches the product colour, as the display of the colour depends, in part, upon the monitor you are using.

 

  1. Errors on our Website. Prices and availability are subject to change without notice. Errors will be corrected where discovered, and Safe Case reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Safe Case will issue a credit to your credit card account in the amount of the charge.

 

  1. Sales Tax (VAT) Policy. We do business throughout South Africa and around the world and accordingly collect sales and use tax (VAT) as required by applicable law. However, the law governing our obligation to collect sales tax (VAT) from online purchases may change, and we may be required to collect sales tax (VAT) from you without notice if there is a change in the law governing online sales or exports.

 

  1. Paying for your order. After you place an order using our “Shopping Cart”, we will check the information you give us for validity, such a valid method of payment or valid shipping address. We will process a refund if we reject an order.

 

  1. Order Acceptance / Confirmation. Your receipt of an electronic order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Safe Case reserves the right at any time after receipt of your order to accept or decline your order for any reason.

 

  1. Backorder Policy. If the product you have ordered is currently unavailable at any of our warehouse locations, this item may not have been available either when you ordered it originally or another customer’s order placed ahead of yours may have depleted the available inventory. We apologize for this inconvenience. Many backordered items are restocked within 5-15 days. With that in mind we will keep your order open and do our best to ship the item you ordered.

 

  1. Validating Your Order. After you place an order using our “Shopping Cart”, we will check the information you give us for validity. We reserve the right to reject any order you place with us without giving any reason. If we reject your order, we will attempt to notify you using the e-mail address you have given us with the order.

 

  1. Shipping. All National and International addresses are charged full shipping charge. Items will be packed and shipped in a manor to ensure the best pricing.   1. Warranty. For 6 months after merchandise is received, all products will be repaired free of charge. If reasonable repairs are not feasible or acceptable, Safe Case may elect to furnish a replacement or make a full refund. Products showing abuse, misuse, alteration or lightning strikes may not be repaired or replaced under warranty. In the event that the product requires repair after 6 months from receipt of order, Safe Case will assist in having items repaired if possible. Customer will be charged for cost of repair and handling.

 

  1. Indemnification. You agree to indemnify and hold us, our subsidiaries, affiliates, officers, directors and employees harmless from any claim or demand (including legal fees) made or incurred by any third party due to or arising out of your breach of any laws or the rights of a third party relating to your use of the Services.

 

  1. Terms and Regulations of Payment Processors, Service Providers, Banks and Issuers of Cards. The Services, apart from being regulated by this User Agreement, shall always be subject to the terms and regulations imposed by Setcom’s payment processors and service providers and your bank and the issuers of your cards whose facilities are utilized in order to accept of affect payment by means of the Services. Therefore all fines, penalties or other charges, of whatever nature, imposed by the payment processors and/or service providers and/or banks and/or issuers of cards on Setcom in respect of or arising from your use of the Services or your conduct of your Setcom account will be debited to your account and you hereby authorize Setcom to pay such fines, penalties or charges from any credit balance held in your account or, if there is no such credit balance, to recover the monies directly from you or by inter alia debiting the bank accounts that you have registered in respect of the Services or to charge your primary card to the value of the fines, penalties or charges. You further indemnify Setcom and Safe Case Corporation against any claim that may be made by the payment processors, service providers, your bank or the issuer of your cards in respect of or arising from your use of the Services or your conduct of your Setcom account against Setcom or Safe Case for any reason whatsoever.

 

  1. Fees. All fees will be charged in the currency of the payment.

 

  1. Prohibited and Restricted Activities. You undertake that Your Information, including your payments and delivery details, shall not: (a) be false, inaccurate or misleading; (b) be fraudulent; (c) involve providing to yourself a cash advance from your card (or helping others to do so); violate Safe Case’s Acceptable User Policy; (e) infringe any party’s copyright, patent, trade mark, trade secret or other property rights or rights of publicity or privacy; (f) breach any laws, statute, contract or regulation; (g) be defamatory, threatening or harassing; (h) create liability for us or cause us to lose (in whole or in part) the services of our Internet Service Providers or other suppliers. If you use, or attempt to use, Setcom’s Services for purposes other than sending and receiving legitimate payments and managing your account, including but not limited to tampering, hacking, modifying or otherwise corrupting the security or functionality of their Services, your account will be terminated and you will be liable for damages and other penalties, including criminal prosecution where applicable.

 

  1. Privacy and Security. We view protection of user’s privacy as a very important principle. We understand that protecting Your information is our most important responsibility. We store and process Your Information on computers located in locations that are protected by physical as well as technological security devices.

 

  1. Governing Law and Legal Disputes. This User Agreement, and the relationship between us, shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any claim arising out of relating to this Agreement or the provision of our Services that cannot be resolved by contacting our Customer Service Centre and escalating the claim, shall be settled through the courts of South Africa. Disputes between you and us regarding our Services may be reported to Customer Service by relating the information to safecase@safecasecorp.com

 

The parties shall keep confidential and not use for any collateral or ulterior purpose the subject matter of any arbitration and all information, documents and materials produced for, or arising in relation to implement and enforce any award or otherwise as required by law.

 

  1. General. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall me omitted and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such paragraph. Our failure to act in any way in connection with a breach by you or others of the Agreement shall not be deemed or construed as a waiver of any right, power, privilege, claim or remedy of ours to act in respect of the circumstances in question or operate so as to bar the enforcement of any such right, power, privilege, claim or remedy in relation to any subsequent or similar breaches. Except in so far as this Agreement or the law provides that a third party may in his own right enforce a term of this Agreement, a person who is not a party to this Agreement has no rights to rely upon and may not enforce any term of this Agreement. This Agreement and the policies referred to herein set forth the entire understanding between us with respect to the subject matter of this Agreement.
